That's a very interesting question. When we use "El hecho de que..." we mostly use the subjunctive because the information that comes after is interpreted as something that is "already known", as opposed to something that you declare as "new" to the listener. It is the same meaning as when using "aunque..." folllowed by the subjunctive.
Sometimes "El hecho de que..." can be followed by the indicative if the information is some kind of "first declaration" to people. Generally this happens when "el hecho de que..." is NOT in the beginning. For example:
Lo interesante era el hecho de que todos lo sabían y no dijeron nada.
The interesting thing was the fact that they all knew it and didn´t say anything.
The fact that they knew it is seen as "first time information" to who is listening, hence the indicative.
